Sir:-

With reference to your letters (56195/22) and

(60979/1922) of the 5th and 12th instant respectively, relative to the Hong Kong Deportation Ordinance No. 19 of 1921, I am directed by the Secretary of State for Foreign Affairs to state, for the information of the Duke of Devonshire, that the reasons for the provision in the China (Amendment) Order in Council, 1920, for

a judicial enquiry prior to the deportation of seditious persons were, firstly, that it was considered that administrative deportation without trial would be difficult to defend in time of peace, were any question regarding it to be raised in Parliament, and further,

that it appeared impossible to dispense with the formality of a judicial enquiry in view of the limited powers conferred by the Foreign Jurisdiction Act upon His Majesty's representatives in ex-territorial countries.

There is no information in this department showing the practical working of the Order in Council; but a copy of this correspondence is being forwarded to His Majesty's Minister at Peking with a request for a report on this point, a copy of which will be sent direct to the

Governor of Hong Kong.
